DIVISIONAL COURT DISMISSES MERCK'S APPEAL
In a unanimous decision released on February 13, 2009, the Divisional Court dismissed the appeal of the Defendants Merck Frosst Canada Ltd., Merck Frosst Canada & Co. and Merck & Co. Inc. ("Merck"). Merck had brought a motion in the Ontario Superior Court seeking a stay of this action on the basis of a similar national class action commenced in Saskatchewan. Justice Cullity of the Superior Court refused to grant the requested stay. The Divisional Court's decision last Friday upheld Justice Cullity's decision.
Merck has advised it will seek leave to appeal to the Ontario Court of Appeal from the Divisional Court's decision.
