MERCK'S APPEAL TO THE DIVISIONAL COURT
In reasons released on November 28, 2008, Justice Bellamy of the Ontario Superior Court of Justice granted the Defendants Merck Frosst Canada Ltd., Merck Frosst Canada & Co. and Merck & Co. Inc. ("Merck") leave to appeal to the Divisional Court the dismissal of a motion to stay this action on the basis of a similar national class action commenced in Saskatchewan. Merck's motion for leave to appeal the certification of this action was denied.
The Divisional Court has set aside February 10 to 12, 2008 for the hearing of this appeal.
